This Privacy Notice applies to all Lexar products and services, except those products and services that have a separate privacy statement.

This Notice applies to individuals, anywhere in the world, who interact with Lexar’s websites or applications, visit our facilities or use our services.
This Notice covers Lexar’s global privacy and information practices and applies to our websites, applications, physical facilities, and related services. Please remember that our Terms of Use may also govern your use of our products or services.
Lexar may process the personal data of customers, partners, vendors, visitors, or other individuals who are engaged in business with or seeking to engage in business with Lexar. This Notice applies to these Individuals regardless of their geographic location during their interactions with Lexar.
2. WHAT DOES LEXAR DO
Lexar is a leading provider of high-performance digital storage solutions, including memory cards, USB flash drives, and SSDs designed for photographers, videographers, and tech enthusiasts, with group companies all around the world. Founded in 1996, Lexar focuses on reliability, speed, and durability in its memory products, catering to both consumer and professional needs.

3. YOUR RIGHTS AND PREFERENCES
Lexar allows you to exercise your privacy rights and manage how we use your data.
Privacy and data protection laws in different countries and regions around the world give individuals certain rights in relation to their personal data. We conduct our privacy practices according to this Lexar Privacy Notice and the relevant laws of the countries or regions in which we interact with you. Depending on where you live, you may have the rights described below.
- Right to know the personal information that we collect, including the sources from which the personal information is collected, our purpose(s) for collection, and the categories of recipients with whom we have shared your personal information, including any sharing with third parties for their own marketing purposes

4. TYPES OF INFORMATION WE COLLECT
We collect information that relates to you and your interactions with Lexar.
When used in this Notice, “personal data” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual (“data subject”), and includes “personal data” or “personal information” as defined in applicable data protection laws. Data that cannot be associated with you, such as aggregated or de-identified information, is not personal data. Lexar commits to keep such information in its de-identified state and will make no efforts to re-identify such data.
A. Personal Data You Provide
When you interact with us, we collect information in the context of our relationship (e.g., vendor, host, employer, etc.). Providing us with some Personal data may be required in order for you to interact with us. You may be invited to provide additional Personal data to personalize your interactions with us.
B. Personal Data from Third Parties
If you interact with Lexar through a third party (including business partners, marketing agencies or service providers) or purchase our products from them, we may receive personal data about you from that third party.
We may use third party services to supplement, validate or increase the accuracy of personal data we hold about you. For example, we use third parties to validate your mailing address so that we can deliver our products to you more efficiently. We may also collect your contact information from marketing partners when we engage in joint marketing or co-branding activities, your IP address or location information from service providers to offer certain products and services relevant to your location, and data from your social networks to authenticate your product use with us, or that you grant permission to our products or services to access.
The personal data that you share with third parties is not controlled by Lexar or covered by our privacy notices until we collect such personal data or associate other information with personal data we already have about you. We encourage you to review third party policies and privacy settings so that you understand how the personal data you share with third parties may be used or shared with others.
C. Automatically Collected Information
We and our third-party partners may automatically collect usage information when you interact with us, including about your activity on our services. For instance, we and our third-party partners use cookies, beacons, pixels, and other tracking technologies (“Cookies”) to automatically collect technical information, such as URL, cookie data, IP address, device type, unique device IDs, device attributes, network connection type (e.g. WiFi, 3G, LTE, Bluetooth) and provider, network and device performance, browser type, language, and operating system. The Cookies contain information which enable us to identify you so you do not have to re-enter certain information each time you visit our websites (such as your language or location), keep track of which of our webpages you view, your shopping choices, and provide you a better overall website visitor experience. We and our third-party partners may also monitor and record information about the content, products and services you interact with, including the pages and videos you view, the links you click, the content provided through chat, forums and forms, and similar information about your user experience, which help us measure the effectiveness of our websites, further develop our products and services, personalize your interactions with us, and aid in the delivery advertisements.
D. Derived Information
Lexar and its third-party partners may use information we have about you to draw inferences and we may then use those inferences to gain a more complete understanding of your preferences. We use preference data in order to offer you potential choices, make recommendations, or to alert you to products or services that may be of interest to you.
E. Children’s Information
Lexar does not market its commercial products or services to children. If you are under 16 years of age, do not supply any personal data to Lexar. If you wish to purchase a Lexar product or use our services, please ask your parent or guardian to handle these transactions for you. Please immediately contact us if you become aware that a child under the age of 16 has provided us with personal information.
F. Information We Collect
Depending on the products and services you use, we may collect and have collected, including within the preceding 12 months, different kinds of personal information from or about you:
- Personal identifiers, including name, username, email address, phone number, and mailing or shipping address and other contact information.
- Commercial information, including products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
- Financial information, including certain limited credit or debit card information.

Service Providers and Other Companies
We may share personal information with service providers and other companies that provide services on our behalf, such as website hosting; email services; marketing; advertising; sponsoring of sweepstakes, contests, and other promotions; auditing; payment processing; fulfilling customer orders; data analytics; providing customer support; conducting customer research and satisfaction surveys; cloud storage services; and other services that assist in providing or selling our products and services. It may be necessary—by law or as a result of legal process, litigation, or requests from public or governmental authorities within or outside your country of residence—for us to disclose personal information. 7. INTERNATIONAL DATA TRANSFERS AND THE DATA PRIVACY FRAMEWORK
When we share your personal information with our partners, Lexar-affiliated companies, and service providers, your personal information may be transferred to and/or made accessible from countries out of the European Economic Area or the People’s Republic of China. In such circumstances, we will enter into model contractual clauses as adopted by the European Commission or the Cyberspace Administration of China, as applicable, or rely on alternative legal bases, and implement mandatory measures to act in accordance with applicable laws. For some of our services, your personal information may be transferred to and/or stored and processed on servers located in the United States, or in other locations outside of the country where you reside for the purpose of providing the services to you. By using our site or otherwise interacting with us, you acknowledge the transfer of your personal data to, and the processing and storage of your personal data in, countries outside of your country of residence or the point of collection.
8. MANAGING YOUR PRIVACY
You have a choice about the marketing communications you receive from us, and our use of cookies and other tracking technologies when you visit our websites. While you have the right to select whether you receive promotional messages, you may still receive other non-promotional messages from us in connection with an order or customer service request.

Please refer to our Cookie Policy for additional information about these practices and how you may be able to control or disable these Cookies. Please note that even if you elect not to enable Cookies for interest-based advertising, you may still receive advertisements, they just won’t be tailored to your interests based on those Cookies. Also, if you elect to receive Cookies and later delete your Cookies, or use a different browser or computer, you will likely need to renew your choices.
9. DATA RETENTION
Lexar retains and uses your information in accordance with and as permitted by applicable law and regulations:
We will retain your information as long as necessary to serve you, to maintain your account for as long as your account is active, or as otherwise needed to operate our business.
When you close your account, we may continue to communicate with you about our products and services, give you important business updates that may affect you, and let you know about products and services that may interest you, unless you have elected to not receive marketing communications from us.
We may also continue to use some of your information for business purposes and to improve our offerings.
We will retain and use your information as required by applicable regulations and Lexar’s records and information management policies to comply with our legal and reporting obligations, resolve disputes, enforce our agreements, complete any outstanding transactions and to detect and prevent fraud.

Please be advised, however, that while we strive to protect your information, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction, or inadvertent disclosure of your information. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the “Contact Us” section below.
11. CHANGES TO OUR PRIVACY NOTICE
We may make changes to our Privacy Notice or our supporting privacy procedures at any time.
From time to time, we may change or update this Notice. We reserve the right to make changes or updates at any time and without prior notice to you.
